The United States' health care system was once the envy of the world. The very best doctors and hospitals provided the best affordable patient care and thousands of private charities provided health care services for the poor. The ever-increasing participation of the government and third party payers have taken decision making away from doctors and patients and eliminated the free market aspect of our health care system. Unfortunately, Obama's answer to the healthcare crisis further cripples the market and creates a universal healthcare entitlement that will undermine quality of care and access. A pillar of ObamaCare was put in jeopardy Tuesday as two appeals courts split on whether the law’s premium subsidies are legal in 36 states.

In the first ruling, the D.C. Circuit Court of Appeals said the Affordable Care Act (ACA) does not permit the IRS to distribute premium subsidies on exchanges established by the federal government.

Hours later, the 4th Circuit Court of Appeals came to the opposite conclusion, ruling that the IRS in fact has the authority to issue the subsidies on federally run exchanges because of ambiguity in the law.

The contradictory rulings thrust ObamaCare back into the headlines and raised the possibility of another Supreme Court showdown between the Obama administration and opponents of the new federal healthcare system.

COURT DELIVERS CONFLICTING RULINGS ON OBAMACARE

The cases deal with the federal government's ability to offer premium tax credits to people who purchase insurance through the federal insurance marketplace that serves the majority of the 8 million consumers who have signed up for private coverage for 2014.

A three-judge panel of the U.S. Court of Appeals for the District of Columbia Circuit ruled in a 2-1 decision that the Affordable Care Act allows subsidies that help pay for insurance premiums to be offered only to consumers who purchase private health plans through exchanges run by states.

The judges suspended their ruling pending an appeal by the administration. The Obama administration said it would appeal to the full circuit court, a process that could take up to six months, and stressed the ruling would have no impact on consumers receiving monthly subsidies now.

Hours later, a three-judge panel of the 4th U.S. Circuit Court of Appeals in Virginia ruled unanimously to uphold the provision, saying the wording of the law was too ambiguous to restrict the availability of the funds.

WASHINGTON (AP) — A federal appeals court delivered a serious setback to President Barack Obama’s health care law Tuesday, potentially derailing billions of dollars in subsidies for many low- and middle-income people who bought policies.

In a case before the U.S. Court of Appeals for the District of Columbia Circuit, a group of small business owners argued that the law authorizes subsidies only for people who by insurance through markets established by the states – not by the federal government.

Judge Tosses Ron Johnson's Lawsuit Against
Obamacare Subsidies

A federal judge on Monday threw out Wisconsin Republican Sen. Ron
Johnson's lawsuit challenging the federal funds that lawmakers and their
staffs get to subsidize their HEALTHCARE COVERAGE under Obamacare, the
Milwaukee Journal Sentinel reported. 
U.S. District Judge William Griesbach ruled that Johnson didn't have legal
standing to bring the case, the newspaper reported.

Johnson filed his the lawsuit in January against the U.S. Office of
Personnel Management and its director. 
Under the AFFORDABLE CARE ACT, lawmakers and their aides have to buy
INSURANCE PLANS created by the law through the Obamacare exchanges. 
The Office of Personnel Management said last year that the government will
keep helping members of Congress and their staffs to offset the plans'
costs, just as for other federal employees.
But Johnson had argued that the FINANCIAL ASSISTANCE gives the lawmakers
and their aides special treatment — and breaks the law.

GOP Congressman Sees Supreme Court Future For Obamacare Origination Clause Lawsuit

Forty Republican House members are counting on the success of a lawsuit filed by the Pacific Legal Foundation that challenges the Affordable Care Act on the grounds that it violates the Constitution’s Origination Clause. Article I, Section 7, clause 1 of the U.S. Constitution mandates that "All Bills for raising Revenue shall originate in the House of Representatives.

A new Department of Health and Human Services regulation would slow the growth of premiums charged to subsidized ObamaCare shoppers, shifting more costs to the government.

Over 10 years, the regulation would add about $7 billion to ObamaCare's budgetary cost, an IBD analysis finds.

That's a relatively small change. But the regulation, contrary to how the Congressional Budget Office (CBO) interpreted the law, is another demonstration of the power that the Affordable Care Act has granted to the HHS secretary. The Senate is expected to approve the nomination of White House budget office director Sylvia Burwell to replace Kathleen Sebelius at HHS in the coming week.
